I know that if you meet a private party face to face and do a transfer between residents of the same state, no FFL is needed for that transfer.

I also know that if you transfer from one state to another, that the transfer has to go through an FFL in the receiver's state.

But what about the situation where you are trying to do a transfer of (hypothetically) a CZ handgun from Plano in exchange for a Ruger handgun from Austin. I know if the parties met in Waco and did the transfer FTF - no FFL needed. But what if the transfer took place via UPS? Does it have to go through an FFL?

It would be legal to ship a handgun to an unlicensed person (not an FFL) within a state if any carrier would do it. The last time I checked, UPS and FedEx would ship only to licensees. Lone Star Overnight (http://www.lso.com/) might do it.

Thanks, Jim. That is pretty much what my LGS just said as well.

And I have a LSO drop box at my office. Prices on that are GREAT as well.

I traded guns with a member of this forum via ups and had no issues. Rifle for a handgun.

http://www.atf.treas.gov/firearms/state ... /texas.pdf had nothing about intrastate shipment so no. Is there a law that I have to? If so point me to it so i dont make that mistake again. I did ship a pistol out of state via UPS before and the lady at the counter didnt say anything about it (i told her) and just stuck a normal label on it.

Federal law requires you to follow the carrier's rules:

(B8) May a nonlicensee ship a firearm by common or contract carrier?
A nonlicensee may ship a firearm by a common or contract carrier to a resident of his or her own State or to a licensee in any State. A common or contract carrier must be used to ship a handgun. In addition, Federal law requires that the carrier be notified that the shipment contains a firearm and prohibits common or contract carriers from requiring or causing any label to be placed on any package indicating that it contains a firearm.

It seems that the carriers' employees' knowledge of their own rules is spotty.

I have done it, barrel and slide in one package, frame in another, mags and holster in a third… does not make it right. But it worked, and I don’t see how it’s illegal.

I'm thinking that if we do make it to Waco, we will need to make a day / range trip / SOMETHING out of it. Any IDPA up that way? I could sure go for that! But I would rather save the gas and buy ammo with the money saved

The frame is a firearm in the eyes of the law. Everything else is just parts.
