ok, I got a question that was asked to me today at Church, a good friend of my wifes was charged with sell alcohol to a miner, she went to court ahd the deal she got was that if she would be a good young lady it would after six months be Dismissed the charge as of the Tx. Penel code is a Class A miss. does she have to wait the 5 years after this or can she apply for her CHL and not worry about it???

I have read and reread the Handbook and still don't know what is the answer.

Any help with this .

Thanks

AFAIK, dismissals still count as convictions as far as CHL laws go.
She'll have to wait 5 years from the date of her conviction.

Deferred Adjudication

Isnt this situation defined as Deferred Adjudication ? If that's the case one's CHL is denied until 5 yrs after the time frame.
