Need a CHL??

So, got the new issue of Ye Olde TSRA mag yesterday. Mr James Dark wrote a nice lil piece about out of state CHL's.
thought I'd pass along some of his wisdom.
basically, if you're concerned about your CHL expiring while you're waiting for the renewal process, many have advocated getting a second license for the in between time. The Utah license is a great idea, and Mr Dark bought up another idea, for those of us who already have our Tx CHL.

you can send a copy of your DL, your CHL, and a check for $26 to PENNSYLVANIA!!! and get one of their licenses in about a month!!!!!!!!!

Hmm, maybe time to start collecting CHLs. Pad the numbers some. :D

I only have TX, PA, VA, and FL.
I might try the UT one on for size soon. I sent off for the three non-res at the same time so if'n I need one for when DPS takes 6 months to do mine I will be ready.

Then every Texas CHL should order one (that's pretty much what is required) from New Hampshire for $20 for a 4 year permit*: Application:

$10 for residents which is what a Texas license SHOULD cost (at most) -- and they do it entirely by mail if you wish.
But do note: A Texas only resident is not likely protected by any out-of-state license if the Texas license is expired.

That's absurd!! Please explain your reasoning.
Texas honors nonresident licenses for Texas residents.
Whether a Texas license is current or not is irrelevent!

The article by James Dark in my copy of the TSRA mag says "PENNSYLVANIA" license by mail for $26.
I'm confused?

Texas honors nonresident licenses for Texas residents.

That is news to me -- did that change or has it always been that way?
(And are you certain...but I am not one to require you to cite the actual statute.)
Texas requires driver's licenses for residents to be from Texas right? And doesn't require CHLs to be the same way?

As with any non-resident license, you are not legal in school "gun free" zones.

An interesting question deals with the failure to display your foreign CHL when asked for identification by a LEO. A Texas CHL holder is required to do so by Tex. Gov't. Code §411.205. The first-offense penalty for failure to show your CHL is the suspension of the CHL pursuant to the procedures found in Tex. Gov't Code §411.187. A second offense is a Class B Misdemeanor, but only if the license had previously been suspended pursuant to §411.187.
Here's the interesting part. Texas has no authority to suspend a CHL issued by the State of Utah. Since there can be no suspension of a Utah CHL, then a second and subsequent failure to show your CHL cannot be a Class B Misdemeanor per Tex. Gov't Code §411.205(b), since there could not have been a suspension pursuant to §411.187. So it appears that a person carrying on a foreign CHL is required to show their CHL to a LEO, but there is no penalty for failure to do so. I am not suggesting that anyone carrying on a foreign CHL should fail to show their CHL!! For a Texas resident carrying on a foreign CHL, this would almost guarantee a chance to see if my reasoning on this issue is correct.

Here is the relevant statute:
§ 411.205. DISPLAYING LICENSE; PENALTY. (a) If a
license holder is carrying a handgun on or about the license
holder's person when a magistrate or a peace officer demands that
the license holder display identification, the license holder shall
display both the license holder's driver's license or
identification certificate issued by the department and the license
holder's handgun license. A person who fails or refuses to display
the license and identification as required by this subsection is
subject to suspension of the person's license as provided by
Section 411.187.
(b) A person commits an offense if the person fails or
refuses to display the license and identification as required by
Subsection (a) after previously having had the person's license
suspended for a violation of that subsection. An offense under this
subsection is a Class B misdemeanor.

That makes more sense. Last time I checked, NC didn't issue non-resident Concealed Handgun Permits and there were no pending bills. The problem I have with NH and PA licenses is their instance on references, but I was never a fan of "may issue" anyhow.

I typically read read Alice Tripp's column first; hadn't gotten to James's...but I will.
My Utah paperwork was delivered in Salt Lake on June 6, so that license should be on an in perpetuam cycle with my CHL expiration.
