I was in a conversation with my mom today and she asked me if it was legal for her to carry her 9mm on her while she was riding her motorcycle. I wasn't sure if the new update to the traveling law applied to that so I figured I'd ask rather than give bad advice. Anyone?

She doesnt' have her chl yet.... but i'm working on it.

I'll make a guess, but don't take it as the LAW until someone else chimes in here.

I would think that it would be fine to carry the pistol somewhere ON the motorcycle where it is concealed. NOT on her person.
In other words, if she has saddle bags I think it would be fine. IF she has some other sort of compartment built into or bolted onto the motorcycle, I think that would be fine too. She is NOT allowed to carry concealed on her person while riding the motorcycle in my opinion.

She can carry on her person while she is with the motorcycle.

The problem I see with that is that once she arrives at a place other than her own residence or other place that is not under her control and she gets off the motorcycle (to go inside or otherwise leave the motorcycle). Then she is tasked with removing the pistol from her person and concealing it somewhere on the motorcycle (which in my opinion is where it should have been in the first place). If this is observed by anyone and especially a LEO, there could be problems.

Is there a way you could wrap a fanny pack style "holster" around the gas tank or vertical section of the handle bars every time you come and go?

You can get a Tommy's Gun Pack (or similar), carry it inside the pack in-hand from residence to motorcycle, remove and wrap to secure to motorcycle, drive. Arrive at destination, remove from tank, "secure" in locked saddle bag (how secure are these?). Reverse the process for the return trip.

That way, it is both accessible and off her person.

It would really behoove her to get CHL ASAP if possible.

good ideas buys and my same basic thoughts too. The fanny pack is a good idea too. I'm going to encourage her to get an actual holster for it too since she's taken to "putting it in her pocket" when she's walking around her property.

Ya, i'm on her about the chl. with my mom though its more like herding a cat, even when you present logical and compelling arguments. You have to steer her around so that she thinks it's her idea :)

While I cannot knowlegably address the initial question, I would respectfully request that she consider getting a CHL, assuming she is not somehow prohibited. This would solve all of the problems metioned, and then some. While one might not want to shell out the $140 fee plus the training expense...and the wait, the cost would be minimal compared to the expense of guessing wrong, or even guessing correctly and having an arresting officer guess wrong.

I would also be concerned with having to leave the weapon in some locked case on the bike. If some bad guy were to observe her stowing the weapon and had a bit of time, it probably would not be too hard to get to the weapon.

The problem with many of the "what if' or "can I" scenerios is that in many of the circumstances, there is not much case law to go on. This means that initially things could go in any direction and the final result might end up being what a group of jurors thinks is correct. Their opinion may or not agree with yours (ours) but theirs is the one that counts. For most of us a CHL is by far the path of least resistance.

Why not just use a tank bag? You can get them for almost any brand/model of motorcycle. They will definitely hold a gun. The gun is out of sight. Tank bags are located in front of the driver, where the gun can be reached. And, you can take the bag with you when you park the bike.

if mom were to get picked up and jailed by the police I would feel horrible for giving her that advice.

Before I got my CHL, I talked to many LEOs (some friends of mine, some random) about this very subject. This is what they all said.
Yes you may carry on your motorcycle....on your person or not. If it is on your person, you must stow the weapon on the motorcycle BEFORE you get off of it.

I carried it on me most of the time and just stowed it when I arrived to where I was going. Other times I just tossed in the saddle bags. For my personal use I dont like fanny packs, backpacks, or tank bags (just doesnt look right on my Harley). However, they are all very good ideas.

That's fine if you have a CHL but I wouldn't tell an unlicensed person to carry in a restaurant or store.
