Arrest Record Documentation

What do i need in terms of arrest record prior to getting my chl? Does this need to be a paper copy or can it be electronic?

DPS says that you need a certified copy of the disposition of the case from the clerk of the court in the county where the alleged offense occurred. Certified copies carry a raised stamp.

I don't know, but a little bird told me that DPS will accept faxes when the offense was one that would not have been a disqualification even if you had been convicted (misdemeanor more than 5 years ago).

IMHO, e-mail is too easily faked to be of any legal use.

Oh ok. So even though I was arrested in the city of Irving. I went to court in Dallas County, so I would get my case disposition from Dallas County, not my arrest record from Irving city.

Yes. DPS wants the disposition of the case (not guilty, guilty, deferred adjudication, etc.).

I'm a new member, and new to the whole CHL process, so please, bear with me.

My boss, who recently got his CHL, told me that in order to get my CHL, I have to disclose any legal trouble that I have gotten in, in the last 10 years.

So, in my youth, I recieved a few MIP's, a couple speeding tickets, and two or three years ago, I got a PI, which never even went to court, I just sat the night in jail, and got picked up the next morning.


What does all of this mean for me, in regards to getting a CHL? What steps do I need to take to ensure complete and total compliance with the CHL "pre-requisites"?

The key is if you were taken into custody and fingerprinted. Citations like traffic tickets and MIP don't count.

If you were taken into custody and fingerprinted, you must list the arrest on your application. You are also supposed to supply documentation of the disposition of the case from the clerk of the court.

In a case where charges were dropped years ago, probably no documentation exists now. In that case, you can get a letter from the clerk of the court saying that they have no record of your arrest or conviction.

If you list an arrest and don't provide the documentation, DPS will ask for it later.

Alrighty....So really, the only thing I need to worry about is the PI. Cool. I'm pretty sure I was fingerprinted, so I guess I need to go by the court and have them supply me a letter.

Do you think it would be prudent to go ahead and get stuff for the MIP? Or not? TIA

If you weren't arrested, don't bother. It doesn't matter to your CHL application, and there probably is no record of it anywhere now.

What about out of state Class B misdo from 2001? I have no records in my possesion due to divorce ,I lost that too.

Just contact the court where it was dealt with. They can get you documentation.

You have to look up the laws of the specific state.

Usually crimes classified as A or 1st degree are the most serious.
