Started New Job - CHL Clarification

I started a new job today, and received my employee handbook - can I carry (once I receive my plastic)? I did not see any 30.06 postings on the building or parking lot. This is what the handbook says:
Listed below are some of the rules and regulations of **** to which you should always adhere. Types of behaviors and conduct that the Company considers inappropriate include, but are not limited to, the following:
  • Having unauthorized firearms or weapons on **** premises or while on **** business

IANAL, but looks like legally you can carry, but your company can fire you if they find out.

It says 'unauthorized'. If you have your plastic, maybe you can make the argument that you're 'authorized' by the State of Texas. :biggrinjester:

That is written notice which is all they need to keep you from legally carrying. If you carry, you can be arrested. 46.035(f)(3)(A) is the definition of "Written Communication". This is from here http://www.txdps.state.tx.us/ftp/forms/ls-16.pdf" onclick="window.open(this.href);return false; which is page 34 of the CHL Handbook. Sorry.

Authorized - does that mean having your plastic or having their permission? Who knows? I'd personally say just conceal carry and ask for forgiveness if you ever get caught, but if you are truly concealing then the only time someone should know you are is if a situation occurred where you had to pull your weapon. I wouldn't worry about being prosecuted but I would worry about losing the job, but since Texas is an at will state, they can fire you for whatever reason they want anyway.

There doesn't seem to be a 46.035(f)(3)(A) so it seems to me that you might actually be reading the section 30.06 but have interpreted the line the way it was printed in the pdf as being such.

The written communication to prevent legal carry by a CHL is in 30.06:

(3) "Written communication" means:
(A) a card or other document on which is written language
identical to the following: "Pursuant to Section 30.06, Penal Code
(trespass by holder of license to carry a concealed handgun), a person
licensed under Subchapter H, Chapter 411, Govemment Code (concealed
handgun law), may not enter this property with a concealed
handgun"; or

I just started my new job and my plastic should be here soon.


Policy. The manufacture, possession, use, distribution, sale, purchase, or transfer of the following
substances and/or items while on (company) Premises is strictly prohibited:

Firearms, weapons, explosives and ammunition, except as specifically authorized by (company name here).

I think a lot of us are in that situation.

I think this may be pretty routine for some tech companies around here.

Again?

That does NOT meet the definition of written communication as defined in statute. You could legally carry if that is all that you have received, but you could probably be fired for doing so (of course you could be fired for just about anything - and concealed means concealed, so...).
