ok so a friend of mine was convicted for a felony drug charge some 20+ years ago he now wants to buy a 12 gauge o/u from a pawn shop.i tried to tell him that he was not allowed to purchase a gun because he is a convicted felon.now i had read somewhere that in texas after five years with no other arrests from the date of release or something like that you could get your rights reinstated.
but i also heard even if you do this that federal law trumps state law so he would still not be able to own a gun.
ok for the third thing we have heard was even though he is a felon (non violent)he could not own a gun with a rifled barrel, but he could legally own a blackpowder gun,a shotgun or another gun as long as it did not have a rifled barrel.\
i still say he can not own any gun but please tell me if i am wrong so we can clear this up thankyou

State law says a felon can own a firearm on his own property only, five years after the release from jail. Federal law says no guns ever. This includes pistols, rifles, and shotguns.

But, both federal and state laws do not include most black powder firearms as guns. I think some antique pistols that use cartridges are also exempt, since they were also black powder.

End result is he cannot buy the firearm from the pawn shop. If he is caught with it off his property, he is going back to jail. If he is caught with it on his property, he might still go to jail if the officer calls the feds in.

An employee at the business next to mine was arrested during a traffic stop for an old speeding ticket. Had a 22 rifle behind his seat. Also had a 15+ years ago felony. He is now serving federal time. Expected to get out this summer after over 2 years. They lost their home and everything else. His wife lives in a pop-up camper trailer. The law is the law. Our choices follow us. Tell your friend to avoid firearms unless he has a thing for showering with large groups of incarcerated men.

...and our actions have consequences. This message must be taught in the home beginning at an early age. It can't be learned by watching our elected officials or other entertainment and/or sports figures or by watching TV.
