how true is that the rumor that they are going to outlaw the 40 cal and us it in military and they want to do back ground checks on all guns you own

I haven't heard anything credible about specific handgun calibers being banned.
There are bills in the U.S. House of Representatives that would ban .50 caliber rifles and require additional harassment of firearms owners (background checks and registration). Neither is going to go anywhere in the foreseeable future.
