The fatal shooting happened on the falls' northside.
Wichita Falls police say around 5:30 this morning they went to check out a call on a shooting at the 2700 block of Byrne Place.
When they got there, they found 39 year old Robert Polk dead on the street.

Investigators say witnesses saw Polk trying to kick down the door of a house on Byrne Place.

A neighbor saw the incident and went to check on the person living in the house.

Police say Polk confronted the neighbor.
He was carrying a silver revolver.
Officers say Polk hit the neighbor in the chest with the gun.
The neighbor who had a gun himself shot Polk.
Sergeant Leland Wright says the shooting is being classified as a murder.
He says the shooter hasn't been arrested and hasn't been charged with any crime.
All of the information will be sent to the Wichita County grand jury for review."

I think they mean homicide instead of murder. Reporter probably doesn't even know the difference.

Man with a gun, kicking on door ... No charges sounds like quite the proper choice there ...

I've made the mistake of getting low on gas and having to drive around at night on the north side of Wichita Falls. Parts of town are OK, but others made me real glad to have the CHL ...

I am curious why the BG/DG was armed and kicking the door of a neighbor. There are some very important details yet to emerge.

I'm curious about the part where the police said it was being classified as a murder. And if it is, then why has no arrest been made and no charges filed?

From the details shown in the story it sounds like self defense to me...not murder.

I agree with HighVelocity....there has to be some important details that haven't been released yet.
