I went to a local eatery last night. On the door, there is the usual "Unlicensed possession....", but once you walk in, there is a 51% on the end of the bar. I'm inclined to believe the "unlicensed possession" is accurate, but this place sells a LOT of alcohol around St. Patrick's Day, and other traditional drinking holidays, such that it's really possible that they make most of their money from alcohol sales.

What do you do in this situation?

Just because the booze flows more freely on certain alchoholidays doesn't mitigate the fact that the place is really a restaurant.

That's what I suspect, but I used to know a bartender there, and she financed a trip for 4 to Europe on the tips she made during Mardi Gras a couple of years ago. They sell a LOT of booze.

Look at the actual TABC license and see what it says. If it says "Blue Sign" then they are posting a 51% sign in error. They should only post a 51% sign if their TABC License says "Red Sign".

If you find that their License actually says "Blue Sign" and they are incorrectly posting a "Red Sign" (51%) then you should notify the TABC of their incorrect compliance.

In addition to looking at their license, you could also call the local TABC office and mention the conflicting signs. They can tell you which one is correct, and will tell the bar.

Not to hijack the post, but does the 51% sign have to be posted at the front entrance to the establishment like the 30.06 sign?

By Texas Law, Yes. The Location can get fined by the TABC if it is improperly posted.

The wording is 'prominently at each entrance to the the business premises' in the law IIRC.

For our purposes, however, it doesn't matter. Right now, A 51% location is a 51% location, even if they have no signs posted, and it is illegal to carry regardless of any signage.

Starting september, the law changes. If the signs arent posted properly, then it is a Defense to Prosecution that you were not notified correctly. Which means, you could still be arrested, still go to jail, and still have a trial, where you will be found innocent.
