Another Reason to Carry

Believe me, i have full respect for our LEO's, but if we happen to get the bad apple then it doesn't much matter. No one is going to care for you or your family as much as you do.
Case in point

I didn't see anything about how the BG got the drop on her, but some situational awareness might have helped. (on her part)

Is anyone surprised that NYPD cooks their stats? The whole state does this. I lived in LI and was victim of an assault... He said it was harassment and that assault is only when they use a weapon. I corrected him, that's aggravated assault. I had bruises, holes were in my wall, and a witness. He refused to do anything.

If you were physically attacked and had bruises, that's battery. It would be an addition to the assault charge.

Possibly in New York where this occurred. I am not familiar with NY laws. But it is not so in Texas. There is no such thing as battery here. Here the assault is either a class C misdemeanor for being offensive (known as assault by contact), a class C misdemeanor for being a threat, a class A misdemeanor for causing any bodily injury (victim says "oww, that hurt"), or a felony for aggravated assault. Agg Assault is usually serious bodily injury or involving a deadly weapon, but there are quite a few things that bring a misdemeanor assault up to the felony level, like the victim's status (age, job, etc.).
