Just think of all the states where it would be illegal for him to help, and all the nannies who want to make it illegal everywhere to think about guns within a hundred miles of a school.

Couldn't they have at least tossed the dude in the drunk tank? Uncooperative victims seem likely to become victims again.

or possibly someone she was too afraid of to press charges, knowing he would be out too quickly or had friends who would be a danger to her or maybe she was illegal and afraid of getting deported (even though we're not doing that any more, it seems)

Sounds like she may have either been intoxicated or under the influence of a drug, and maybe not at her will. Hopefully they ran a tox-screen on her and will be able to tell if maybe she had been slipped a Ruffie (Rohypnol aka. Date Rape Drug) by here so-called 'friend'.

I'm surprised they haven't charged him since he ran into a school yard with a loaded weapon. Anti gun people would be all over him if it were here in El Paso maybe just a matter of time. Sad if it happens.

Which begs the question, isn't it perfectly legal to enter a "no-carry" zone with a loaded weapon if you fear someone is being victimized by a felony sexual assault?

"perfectly legal" - no. "justifiable" - I sure hope so. I'd rather deal with the lawyers than have it on my conscience that I could have done something.

From the Texas Penal Code:
Sec. 9.22. NECESSITY. Conduct is justified if:
(1) the actor reasonably believes the conduct is immediately necessary to avoid imminent harm;
(2) the desirability and urgency of avoiding the harm clearly outweigh, according to ordinary standards of reasonableness, the harm sought to be prevented by the law proscribing the conduct; and
(3) a legislative purpose to exclude the justification claimed for the conduct does not otherwise plainly appear.

...if he can fit into PC 46.035 (h)...that's right, and to do that, he could use PC9.32(a)(2)(B)...based on a reasonable person's understanding of the facts as OP presented them...

We are allowed to walk run charge, or drive into a school yard. It is legal in Texas. I don't know about New Mexico. It is illegal to draw on people or shot at them. There are exceptions and the neccesity rule that offers us some protection if needed.
