I am flying into EL PASO and heading down I10 to US90.. I have shipped my AR to myself.. (to be picked up at a location)..

What is the laws concerning RIFLE transport in the state without a CASE.. I have the BOX I shipped it to myself in..

But I am concerned with transport.. I do have a PA carry permit, not that I think that would matter considering this is a rifle..

I can't just drive with this thing loaded inside the truck obviously...

Can I transport it in the BOX in the rear of the Explorer/Cherokee SUV?? (unloaded)..

Huh, thats news to me. I used to drive around when I was 14 (farm kid) with a loaded AR-15 in the backseat of the truck with no worries, and still occasionally drive around with a loaded AK in the trunk of my car, or even *gasp* in the backseat if I'm heading to the range, etc.

There are no laws concerning rifle carry in Texas. Concealed, open, loaded, unloaded. If you're legal to own it, you can carry it however you want as long as its not "in a manner calculated to alarm".

Sure, that may happen. But its not against the letter of the law unless you're trying to intentionally scare people.

Besides, the OP was asking specifically about carrying in a vehicle...

Some people get alarmed at an interracial gay couple holding hands. That doesn't make it illegal.

Seems to me that should (keyword) be the sheeple's problem, not yours. Of course, you'll probably get questioned by any officers and you might take a ride with said officers, but they'd have nothing to actually charge you with. And I think the Texas' preemption laws would prevent any local ordinances from causing issues, but I'm not 100% positive those extend to long guns.

Thanks.. I just found the TX laws on rifles/shotguns in the vehicle. They can be loaded and such..

First, it obviously aint obvious as you are misinformed. As others stated, you can carry a rifle all you want. Texas law doesnt mention loaded status except for availability to a minor. The penalty is harsher if it is "readily dischargeable". One thing I have learned on this site is nothing is common sense or obvious. Holllyweird and liberal states have distorted things so much that you shouldnt assume anything but ask then verify. I get bored at work and like to read up on stuff so I do verify just about everything. I have educated 4 cops so far on the new license plate law for example (politely with printed material).

Is there preemption with rifles? I seem to remember San Antonio having a city ordinance prohibiting loaded shotguns and rifles....

Perfectly legal in Texas. Rifles don't have to be concealed in Texas, only handguns have to be concealed. There are no legal restrictions for rifles in Texas.

Lots of Texans have gun racks in their pickup trucks, so it's fine. It's done all the time and nobody will be alarmed.

Local Government Code 229.001 covers it.

A friend of mine who used to post here frequently got stopped once by DPS a few years ago with a loaded M4 on the floor behind the seat of his pickup truck. He showed both IDs and informed the officer he was armed when asked. On the way back to his patrol car, the officer glanced down through his back window and saw the rifle on the floor, partially covered by a blanket.

Officer turns back to my friend's driver's window......

"is that an M4 behind your seat?"

"Uh....yes."

"Is it loaded?"

"Yes."

"Oh. OK."

Officer heads back to his car and comes back a couple of minutes later with a warning ticket and an injunction to keep the speeds down.

That's how those things should go down. I love me some Texas. If that same stop had happened in California, the cop would have called in an arty strike on my friend's truck.

There are a fair amount of immigrants in my neighborhood. Alot of them come from that far away Social Utopia called Kalefornea.

I went to a neighborhood watch info meeting and the local sheriff was nice enough to send a deputy to talk to us about safety. One of the Kalefornea immigrants said that he was really worried because he had heard that someone had driven down the street with an "assault rifle" just the other week. The LEO kindly informed the gentleman that this was not illegal in Texas, to which the immigrant responded "but it was an assault rifle"!

I had to work hard to keep from laughing.
