Hello, I have a question about concealed carry laws in Texas. according to the requirements, a person cannot have a class a or b misdemeanor within the previous 5 years in order to obtain a concealed handgun license. I was stopped in september of 2007 and charged with dwi. ultimately the charge was reduced to reckless driving, however with all the court resets my conviction for reckless driving did not occur until june of 2009.

for purposes of obtaining a concealed license, will the date of the offense or the date of the conviction be used? the offense date is more than 5 years ago, and the conviction date is less than five years ago.

It is my understanding that the date of conviction is the date you're looking at.

As your question is posed and with no other information
you will need to wait five years from the date of conviction.

" The date of conviction is the date the judge signs the order and
is used to determine whether a person's five years has expired.
A conviction could occur several years after the date of arrest."
