Firearm Protection Act.
Sponsored by: Representative(s) Kroeker, Baker, Burkhart, Jaggi, Miller, Piiparinen, Reeder and Winters and Senator(s) Dockstader and Hicks
A BILL for
1 AN ACT relating to firearms; providing that any federal law
2 which attempts to ban a semi-automatic firearm or to limit
3 the size of a magazine of a firearm or other limitation on
4 firearms in this state shall be unenforceable in Wyoming;
5 providing a penalty; and providing for an effective date.

(b) Any official, agent or employee of the United
7 States government who enforces or attempts to enforce any
8 act, order, law, statute, rule or regulation of the United
9 States government upon a personal firearm, a firearm
10 accessory or ammunition that is owned or manufactured
11 commercially or privately in Wyoming and that remains
12 exclusively within the borders of Wyoming shall be guilty
13 of a misdemeanor felony and, upon conviction, shall be
14 subject to imprisonment for not more less than one (1) year
15 and one (1) day or more than five (5) years, a fine of not
16 more than two thousand dollars ($2,000.00) five thousand
17 dollars ($5,000.00), or both.

I like the sentiment but I believe it would be un-enforceable.

Define unenforceable. If the feds pass the law and Wyoming starts arresting agents attempting to enforce the UNCONSTITUTIONAL law, what's the federal government going to do? Call out the army to enforce it? They can't call the National Guard. That's controlled by the government of Wyoming, which could call out their National Guard in response.
This is what is known as a conundrum. Wyoming would be right under the Constitution. The federal government would be wrong. And most people in America would know it. (There was a time when I would have written EVERYBODY in America would know it, but I know better than that now. We are surrounded by domestic enemies who despise the Constitution and would like nothing better than to burn it.)

I wish Texas would do the same. I don't even really care if it is unenforceable; it does leave a message for possible future events.

I think this is great. I wish our Texas legislators would do something similar. They don't even have to go as far as making it illegal to enforce the gun ban. I'd be happy if they just make it clear that Texas LEO will not enforce federal gun laws and will in no way provide any support or allow any state or local resources to be used in enforcing them. Oh, and add that any feds who do enforcement had best follow every state law to the letter while they're here.
We may not be able to stop federal enforcement, but we sure don't have to help them and it'd be nice to hinder them where we can. I mean, didn't the feds take Arizona to court in order to stop the locals from assisting in enforcement of federal laws?

I sent a note to James White who is a Texas State Rep, dist 12.
Quoted the bill verbatim.
He's been pretty solid on the issues so far.
Maybe a few more letters to some other reps would be helpful.

I would support a Texas bill with much the same language.

Question: Does this have any impact on guns manufactured outside of WYO (Sig, Ruger, Kimber, etc)? The way I read it, and I admit I may be wrong, this law only applies to firearms and firearm accessories manufactured in WYO, sold in WYO, and that stay in WYO.

Manufacturers might have to change their business models to set up small assembly shops in all the States that might enact similar legislation.

Texas experienced the ATF running amuck down in Waco a few years back, and did not like it.
As I recall various counties around the State began mustering their militias - with a " Come and take it !" attitude.
The Marxists among us are prostituting themselves for all they are worth over this Newton, CT school tragedy - that WAS PREVENTABLE.
The Texas legislature definitely needs to pass a similar law as soon as possible. It is going to come down to the states having to stand up to that circus in D.C., or we can kiss the U.S. Constitution good bye. The LIbs have no use for it - paticularly the 2nd Amendment which enforces it.

The purpose of this WY legislation is to remind the Feds they have no say in regulating items not involved in "interstate commerce". The courts have already decided this one, FYI. When SCOTUS said the Feds could stop a farmer from growing wheat for personal use because it would affect interstate commerce.

The Feds will claim that the gun produced in WY will eventually cross state lines, and SCOTUS will, by precedent, uphold a federal ban, at least on those grounds. A ban may fail other tests, but the IC clause is so completely abused it's makes me sad.
HOWEVER.... if a state is serious about resisting the Tyranny of another gun grab/ban/whatever, they can pass a State law and start arresting federal agents that attempt to enforce federal law, setting up an interesting situation not unlike Medical Marijuana and the REAL ID Act. Good reading here:

Come on Texas! Get on board! Just say NO to Obama edicts and Federal Government intrusions. If the hippies in California and New York want to live in gun free states, that is there business, but don't impose that on us.
