First let me say ya'll are awseome, I really enjoy reading the messages in this small community, if ya'll made a TexasCHLforum shirt - I would purchase one and proudly wear it. but sorry.. can't wear it at work ;-].

Question: is it considered "flashing your weapon" if you get out of your car and the wind blows up your jacket... or if you lean over to pick something up and your weapon is printed? Considering my recent experience with anti-gun folks @ work, I am wondering what would happen if an anti-gun person flipped out and called the police, would I be in trouble?

I assume I would be ok, as I could show the LEO the weapon is 100% concealed and it was a special circumstance (wind, reaching up, leaning forward) caused the print, flash.. or is this not the case? 100% concealment all the time - no matter what.

Asking as I want to be prepared for the not very nice anti-gun people.

I don't beleive you would be in any legal trouble...the issue is if you intentionally fail to conceal. The situations you mentioned were all accidental.

Now socially what you may face has nothing to do with the law.

If the cops get called and the complainant is hysterical the police could take you in and you could spend some time cooling your heals until you make bail. Probably would be able to beat it in court.

Like always its best to avoid such situations.

While someone might call the police to sort things out, it's not a crime nor violation of the CHL to accidentally flash. The only legal trouble comes when a CHL "intentionally fails to conceal"; i.e., you deliberately show your handgun.

You are correct of course, but it could be possible that the flasher could be hauled in to "sort things out"

This has happened to me on occasion, the last time a few months ago in the parking lot of the local DPS office. My daughter and I were there during one of our west Texas dust storms, and I was walking the dog around the building. As I rounded a corner, a gust blew my jacket straight out behind me just as a trooper came out of a side door. My G21 with two mags in a shoulder rig was clearly visible. The trooper just nodded and walked on.

My son and I frequent a hamburger joint on the north side which is a city cop lunch spot. When we're in there, we always get "made", and we exchange greetings and go on. One day last summer, the temperature hit 107, and we went there for lunch, both wearing jackets. One officer was clearly startled when he noticed a bulge on my son's right hip, but he relaxed immediately upon noticing my Galco front-pack; I assume that's not first choice among petty criminals. I can't blame the cops for being a little jittery, as Lubbock at that time was enduring a string of a dozen or so armed holdups in stores, some nearby.

Personally, inadvertent exposure or printing have not been an issue for any of my family. The officers who have noticed have been friendly, and not made it an issue, or even commented. I don't think I have ever been "made" by a non-LEO.

A while back my wife and I were going into a liquor store when a gust caught my jacket and blew it WAY back behind my carry gun. A couple of wide eyed customers noticed, but the funny thing to me was when I got to the counter and the clerk wanted to chat about my piece.

I don't think anyone would have questioned that it was totally inadvertant.

I've accidentally flashed many times. Once, I nearly lost my gun in wal-mart due to a temporary holster failure. (Charles finds this amusing.)

You just have to learn from it. If something doesn't work at some point, try something different. I learned in my wal-mart excursion that a 1911 doesn't ride well in low-rise jeans, no matter how nice the holster is.

I've also learned that I have to reach for items on top shelves with my non-dominant hand and use my right hand to discreetly hold my shirt down. Now I probably wouldn't get arrested for failure to conceal, but the lines in the grocery store may part like the Red Sea, and not because my name's Moses.

I was loading some groceries into my wifes car the other day. I bent down and reached across the seat to move something, not aware that my shirt was riding up over my XD paddle rig. When I finished and the couple walking up between our car and theirs to get in looked like they had just seen a ghost I realized what they had just seen while my shirt was up a bit. I simply told them to have a good day and went on about my business. My expierence has been if you don't freak out and make a big deal about it, neither will they. After all you have done nothing wrong so don't act like it. JMO
