Sounds like drinking involved, not sure if that also included the shooter.

Probably police had a lot of witnesses.

Lakeview police say Smith returned to the house in the 800 block of Shorewood Drive with his dog around 4:30 a.m. Sunday. The owner called 911 when Smith refused to leave
Smith had a history of arrests for dwi, criminal mischief and resisting arrest, according to records.
Why would you show up at someone's house at 4:30 am with a dog? The history of criminal mischief suggest he was not there on just a leisurly dog-walking stroll. A dog can be a lethal weapon.

With a gun in hand and a dispatcher on the line, the homeowner said he ushered Smith out into the street. He claims Smith lunged at him, so he shot him three times.
There's not enough details to know whether this was a clean shoot. Still, this just strengthens the argument to stay inside your house in situations like this.

:iagree:

Sure sounds like the guy went back to the "party" with bad intentions.

A better head line would be
Nighttime trespasser with criminal record shot by home owner.

Press still writing about it. Man shot in street. Many neighbors unhappy that it is not being investigated thoroughly. Shooter is a doctor. 4:30 am.

04:30 AM. The autopsy will be interesting to see what if anything was in his system, drugs/alcohol.

Too bad they can't test for an overdose of stupid. But maybe his record makes that redundant.

How long did it take for the local leos to get there after he called 911? Maybe he had no choice but to use deadly force.
