Private Day care with Pre-K and Kindergarten classes?

If one of my children is in a private Day Care facility that also has Pre-K and Kindergarten classes, do I have to abide by the same law as with a regular Public School?
Note: no 30.06 sign is posted.

Do you know, how I can find out, if a given day care that happens to have a Pre-K class or a Pre-K plus Kindergarten meets the definition you provided?
I can't seem to find that info on their website, and I don't really want to ask them openly, lest they freak out about a parent with a CHL...

I don't think either of those would include schools that just do pre-K as there is no accreditation for such. Just sayin'.
No caselaw here that I know about. Basically: We don't know what would happen.

But he stated it had a Kindergarten as well, so may be privately accredited and that would make the pre-K portion potentially off limits.
