If somebody owns an AR-15 rifle and an AR-15 pistol with a 10" barrel, does ATF consider that constructive possession of a SBR? I heard Ruger modified the Charger just enough to not fit a 10/22 stock to avoid NFA problems.

You would not have an SBR until you mount the 10" barrel on the rifle but there is a catch... If you take the barrel/upper off the pistol and have it with the rifle, you now have all the parts to make an SBR and that is against the law unless you have your stamp.
They made several uppers, give me the model and I can check to see if it can be mounted on any other uppers.

So long as you have one lower in "pistol" configuration (no butt stock, pistol buffer), you can have as many sub 16" uppers as you want.

Just don't have the rifle lower and pistol upper anywhere without the pistol lower. Of course don't put the pistol upper on the rifle lower unless you get a stamp but sounds like you already know that.
