Dallas Homeowner Suspected Of Shooting Student
Clif Caldwell
Reporting
(CBS 11 News) DALLAS Chopper 11 was overhead as police responded to a shooting near Hulsey Middle School in Dallas.
Police from the Dallas Independent School District and Dallas Police Department are investigating the incident.
Officials say three young men, all students at Hulsey, left school sometime around lunch and were allegedly walking along New Hall Street when they were confronted by a local homeowner.
Police say an argument soon started after 49-year-old Jerry Zmolek asked the students, "Shouldn't you be in school?" and they responded, "Shouldn't you be at work?"
The argument escalated and Zmolek allegedly went into a house, got a gun and shot one of the 15-year-olds in the back of the leg. The teenagers injuries were not life-threatening.
After the shooting the students told officials they ran back to Hulsey Middle School at 9339 South Polk and asked for help from security officers.
The teenagers and Zmolek were taken in for questioning. The homeowner is expected to be charged with aggravated assault with a deadly weapon.
According to DISD officials, at the time of the shooting the students should not have been off school property.

I just hope the shooter doesn't have a CHL.
But probably not. If he did, he would know better.
The guy's a moron. I'd make him do time.

Well We all know his vote.
That does sound like a stupid reason to shoot someone.

Something sounds awful fishy about this story. I'm betting there's something not being reported here.

You'd think he would know better with or without a CHL, but then we do not know the whole story. But still, if he could "go inside to get a gun", seems like the argument should have been over when he went inside. Sounds suspiciously like an anger management issue.

Me thinks there is MUCH more to this story than is being told.

Heard on the radio this morning that the shhoter has been released and no charges expected to be filed.
The only reason given was that there were inconsistancies in the kids stories.
Be interesting to see what all really went down here.

I'll say. That doesn't sound ANYTHING like the initial report.
If the guy was having a beef with the kids, and he went into his house, you would expect it to end right there. Judging from the information in the report, he has no obvious need to come back out. Going in to get a gun and THEN coming back out is more than most "reasonable persons" would do, no matter how much they may have wanted to "debate" with the kids.

According to the Dallas Morning News, they think the guy used a bb gun. But the story ends with the guy being charged with aggravated assault with a deadly weapon, just like the one above.
So there's more we need to know.
The guy does NOT sound like a CHL holder.

Glad to hear i was wrong about the anger management problem. Not glad a kid got shot, but the shooter must have been in the right.

Could be a hot headed homeowner....
Or it could have been some bad kids out causing trouble when they should have been in school.
Middle school kids that skip school aren't generally know for their honesty...
But it sounds like whatever happened, the homeowner could have called the police earlier.

. . . 49-year-old Jerry Zmolek asked the students, "Shouldn't you be in school?" and they responded, "Shouldn't you be at work?"
Actually, that sounds like a pretty snappy comeback.
As for the rest . . . if the alleged shooter is being released and
no charges are expected to be filed . . . I'd say the facts presented in the original story are either incomplete or inaccurate.
Possibly both.

If the charges were dropped, there could be aspects to the story that we aren't reading.
It all sounds a bit sketchy to me.
