This is in a similar vein as the Bass Hall and Kimball Art Museum posts, but with a twist... I visited a family members church recently. The church leases space from The Van Cliburn Hall in Fort Worth which I found out is posted Red 51%. I didn't notice the sign on the way in (trying to catch my energetic child running in the door) but did on the way out.

My question, since there was no alcohol being served for other events at the time at this location, does that make the 51% sign unenforceable? I know I may not have beaten the ride and concealed is concealed worked, but I didn't like thinking as I was leaving that I could have been in violation.

This aspect of 51% for a sub-contractor making an entire venue off limits needs to be a priority in being changed in the next session.

Unfortunately a 51% location is a 51% location and doesn't matter if alcohol is being served or not.

How in the world are these two locations legitimate 51% locations?

having never been there my guess would be they have vendors that only sell alcohol set up and probably some law in the TABC statutes allow them to make the place a 51%. just guessing. My way of thinking is that since the hall is rented for events that is where they're are making the money, not alcohol sales.

That's exactly it. The company that does the concessions holds the liquor license and makes more than 51% of their revenue from alcohol sales. So, because they hold the license, then it makes the whole venue 51%.

C-Dub, RetNavy and Keith are correct per a previous thread viewtopic.php?f=7&t=70871. It doesn't seem logical that a vendor or contractor can make an entire venue a 51%, but it is. Thus Van Cliburn, Bass Hall and Kimball Art Museum are 51% posted. That is the reason I say this must be one of the top priorities of the next legislative session.

My two cents worth:

* No government (city, county, state etc.) can have any premises posted 51%. They obviously are not in the beverage alcohol business (or shouldn't be).
* A business is not 51% unless total revenue of premises (or enclosed section thereof) is 51% or more alcohol sales. By having an enclosed section that still allows for bars inside other businesses like a hotel or a Bass Hall. Let them mark an area 51% (point of sale) but not the entire premises.

Obviously we need lawyers like Charles to lay this out in a way that would be able to make it out of committee and ultimate passage. Let's start by getting a new Speaker of the House.

If not, then I'll get back in line and agree with everyone. They are 51% locations according to TABC.

I did move the topic discussion - frustrated by Texas having Joe Strauss as Speaker of the House! As per the previous thread on Bass Hall, HB3218 would have fixed this.
