I am a little slow today - but doesn't ATK make the 855A1 round the DoD purchaced and wouldn't they (ATK) have infringed on the patent or did the DoD actually "develop" the round for ATK to mass produce?

I think door number 2. If the Army took Liberty's design and contracted ATK to make it without purchasing the rights, I wouldn't think ATK would be on the hook for it. There may very well be a clause in the contract indemnifying ATK against liability for something the Army provided, so it wouldn't make sense to sue ATK. That's just speculation, but given that it has gone through the scrutiny of trial, I would expect ATK to be in the clear. (Or they're next.)

When I worked in procurement, we were trained to be careful in our discussions with vendors to not pass on information we had learned from their competitors. This goes well beyond that, tho. Wowser, there should be a few careers in the toilet after this.
