I think door number 2. If the Army took Liberty's design and contracted ATK to make it without purchasing the rights, I wouldn't think ATK would be on the hook for it. There may very well be a clause in the contract indemnifying ATK against liability for something the Army provided, so it wouldn't make sense to sue ATK. That's just speculation, but given that it has gone through the scrutiny of trial, I would expect ATK to be in the clear.
