It depends on which open carry bill you are referring to. There are more than one.roadrunner1340 wrote:if the open carry bill in Texas passes can you still carry concealed
I'm assuming that was a question, since there was no "?" at the end of it. Open Carry will not get rid of CHL, it will simply give you the option to carry concealed, or to open carry. That is true, whether or not the version of OC that passes is licensed or unlicensed. Even if unlicensed OC passes, Texas will still offer a CHL license for purposes of interstate reciprocity.joe817 wrote:It depends on which open carry bill you are referring to. Welcome to the forum.
Just to clarify, unlicensed open carry will still require you to have a valid CHL to carry concealed. Licensed open carry will require a CHL to do either. The Annoyed Man wrote:I'm assuming that was a question, since there was no "?" at the end of it. Welcome to the forum.
That said, unlicensed open carry has almost zero chance of passing in this session.
Admitting that I'm losing track of which bills are what, is that the constitutional carry bill for the "unlicensed open carry...valid CHL to carry concealed"?Keith B wrote:Just to clarify, unlicensed open carry will still require you to have a valid CHL to carry concealed. Yes, thank you. I was thinking "Constitutional Carry" when I typed "unlicensed OC". Keith is correct.Keith B wrote:Just to clarify, unlicensed open carry will still require you to have a valid CHL to carry concealed. I know.... I'm having trouble remembering which bill is which too.Glockster wrote:Admitting that I'm losing track of which bills are what, is that the constitutional carry bill for the "unlicensed open carry...valid CHL to carry concealed"?
Actually, I was incorrect. HB 195 & SB 342 for unlicensed open carry contain the following:Glockster wrote:Admitting that I'm losing track of which bills are what, is that the constitutional carry bill for the "unlicensed open carry...valid CHL to carry concealed"?Keith B wrote:Just to clarify, unlicensed open carry will still require you to have a valid CHL to carry concealed. So, if one of these were to somehow get to a vote, then you would not need a license to carry concealed or openly in Texas. You would still need a license to carry in other states if required by their laws.SECTION 4. Sect. 46.15, Penal Code, is amended by adding Subsection (k) to read as follows:
(k) Notwithstanding any other provision of this chapter or any other law to the contrary, no person shall be required to obtain any license to carry a handgun as a condition for being able to carry handguns openly or concealed in the State of Texas except a person who is prohibited from possessing a handgun under 18 USC § 922.
Yeah, and that's kinda why I was asking so thanks. Does that mean that if HB 195 or SB 342 pass that they would still keep CHL so that we have that reciprocity ability (as discussed above)?Keith B wrote:Actually, I was incorrect. Glad it's not just me as I feel like I need a cheat sheet to try to keep track. And that concern about removing CHL is what was on my mind as well and for that same reason. The Annoyed Man wrote:I know.... So far as I know, none of the open carry bills actually removes CHL from the books. A properly written Constitutional Carry bill would bypass CHL by removing the requirement, but not killing it off entirely. Killing CHL would not be desirable. Here is why......

Thanks! Couldn't remember where I'd seen that but couldn't find it here. The Annoyed Man wrote:Here is your cheat sheet: https://www.texasfirearmscoalition.com/ ... ve-sessionGlockster wrote:Glad it's not just me as I feel like I need a cheat sheet to try to keep track.
