30.06 Class C Citation or Arrest

I understand with the forth coming changes that 30.06/30.07 violations will become Class C misdemeanors and upgraded to a Class A if one fails to leave upon verbal notification.

Will the Class C violation be a citation only as a promise to appear or will it be an arrest with the full booking process? Would this be up to the LEO? Will this class C go on a record where employers and volunteer organizations will be able to find out about it?

Which courts will have original jurisdiction if the violation occurs within city limits? in rural areas?

I am asking out curiosity and not advocating breaking the law.

The penalty is a maximum $200 fine. I assume it would be similar to a speeding ticket.

1. Since it's a misdemeanor, municipal courts in cities and towns, or JP courts in unincorporated areas will be the court with original jurisdiction, IIRC.
2. Most like a promise to appear, unless the offender refuses to ID or otherwise gives the officer cause to believe that he/she will not appear (i.e. Saung "don't expect me to be there" or tearingup the tivket, etc) at a guess
3. Yes, if you're a teacher, or other person required by law to report the offense to your employer, it will show up on a CCH.
