I just read a Facebook post that tells me one of the new Obama laws going into effect is that you can't leave your guns to your family when you die. Has anyone heard anything about that?

It's best to read something about the actual legislation, rather than depend on social media.
My guess is that this refers to changes with NFA - which makes it a bit harder to do NFA if you have lots of people authorized to possess those firearms. As I understand it, it changes nothing for trust beneficiaries...

Here's what I found - it appears only to apply to automatic weapons, to some extent anyone. It came from CNN.com


Close a “loophole” that allows gun buyers to acquire items like machine guns without background checks through a “gun trust” (paywall), a legal entity originally created to allow gun owners to pass weapons to their family members. The number of gun trust applications grew from fewer than 900 in 2000 to more than 90,000 in 2014, the White House said.

I think they're talking about an NFA trust, that isn't just used for Class-3. Now all members of the trust that can be "in possession" of trust items will need to be fingerprinted. As I read it, this is different from beneficiaries of the trust being disallowed.

From the gov's website:
"ATF is finalizing a rule that makes clear that people will no longer be able to avoid background checks by buying NFA guns and other items through a trust or corporation."

I believe that the only real difference is that fingerprints will be required for everyone that can be in possession.

The most common use of the NFA trust in my circle is the silencer....

"The Social Security Administration has indicated that it will begin the rulemaking process to include information in the background check system about beneficiaries who are prohibited from possessing a firearm for mental health reasons."

So crazy uncle Bob might not be able to inherit your weapons..

We're the only other ones with the combination to my out-of-state, 90 year-old father-in-law's safe, and his guns are not mentioned in the will. What're they gonna do?

Funny thing is, it's the government who decides whether one is legally "crazy".
And definitions tend to drift a bit over time, with a little nudging.

I have a gun trust that names my immediate family. I would think we're all covered

I think that's a legit concern - the chances of the government doing it right 100% of the time is near zero.
However, if it's pretty broad - say it's only affecting people who have been adjudicated or otherwise judged incompetent to manage their own affairs, it might be *better* than today's approach of ignoring that data.

That's a fair point - but many aren't even taking a second to look at it - they hear "Obama" and "gun control" and run for the hills, relying on social media to fill in the gaps. I'm all for appropriate criticism of any executive action, I just think that people should take a look before deciding on how it's the end of the 2nd amendment... Many here have called for more enforcement of existing laws and it provides additional resources (I assume that need to go through Congress) to deal with applications rather than letting them fall through a 3-day waiting period or have them rushed through an approval process that fails...

(Note, that's NOT indicating my broad support - I mention it as an example)

So if I want to buy another silencer, then all 5 of the other trustees would have to submit their photos and fingerprints for every form 1/4 submitted.

That's what I understand too. I believe this portion of the action isn't in effect yet, so my guess is that there will be a "run" on trusts:

Final Ruling ATF 41P: "This final rule was signed by the Attorney General on January 4, 2016. It is effective 180 days after date of publication in the Federal Register."

I wish the media wouldn't refer to these things as a background-check-less "loophole" means to own a machine gun, as that's not true.

Prior to sending off your completed F1 or F4, you should simply be able to amend your trust removing the 5 other trustees. Then you only have to send pics/prints for yourself.

Once the application has been submitted, amend your trust again adding the trustees back. BATFE's new rule doesn't require notification or pics/prints when trusts have been amended.
