This is an interesting one... How in the world did he get the taser away and taser two officers!?!

Star-Telegram Staff Writer

Two Arlington police officers were shocked with a Taser gun early Saturday after an inebriated man gained control of it and used it against them.

Angel Marquez, 29, was in the Arlington Jail on Sunday with bail set at $5,000.

He could face charges of aggravated assault on a peace officer, public intoxication and attempting to take a weapon from a peace officer, according to jail records.

The officers had tried to arrest Marquez at the La Chiripa Bar on North Collins Street at 12:43 a.m., but he resisted, assaulted an officer and grabbed the Taser before he was handcuffed, according to an incident report.

The officers' full names and conditions were unavailable late Sunday.


It's gonna be a while before they live that one down. And I would imagine some remedial training to boot.

I though those were 1-shot weapons, or at least could not be rapid-fired...am I wrong? How did he hit BOTH of them? Were they touching or something?

Hopefully they and others will learn from it and have better tactics the next time around. It could easily have read "Suspect Takes Officer's Gun, Kills Officer and Partner." I'm glad both only have to worry about the embarassment of reports saying a drunken suspect got their tazer and gave them "the ride."

HUH!?!?

Forcibly disarm and cause bodily injury to two cops while resisting arrest, and the bail is only $5k?

I've known plenty of people who got orders of magnitude higher bail for much lesser charges, when they were virtually zero flight risk.

Bail is not supposed to be a part of the punishment.

The Taser can be used as a conventional "stun gun" as well. You don't have to fire the barbed projectiles.

Someone asked how both officers were overpowered and "tased". I can't say for certain, maybe just bad luck or circumstance....but most officers do not practice or pursue any additional hand to hand training outside of the academy. Too bad.....since their very lives may depend on those skills one day.

Bail is not supposed to be a part of the punishment.
I don't think he was implying to punish him with bail.

The point of bail is to make certain they appear for trial, and assault on two police officers should require more bail.

Lots of criminals have crossed the border to avoid charges.

I saw a Tyler PD officer on Friday carrying both a handgun and the Taser. The firearm was in its traditional 3:00 spot while the Taser was about 10 to 11 in a crossdraw position. It struck me as odd to carry the Taser crossdraw in a holster so close to the center line.

It is possible IMO in the process of being cuffed to reach back and draw the taser if the officer was too close as the taser would be mere inches from the suspects hands.

I am guessing that the officers in the article will be receiving some remedial hand to hand and taser training.

Story didn't say the (alleged) drunk caused bodily injury, story said he tasered them.

Cops always insist when THEY taser someone, it's to AVOID injuring them, so the drunk should be allowed to make the same argument.

In any case, the (alleged) drunk will learn that the place to fight cops is in court, not on the street.

(Wish the story were a little clearer about why they were arresting him in the first place . . . was it on an outstanding warrant? Was he a belligerent drunk, causing problems in the bar? )

First she (the reporter) says the man used it against them, then attempting to take a weapon from a peace officer, then assaulted an officer and grabbed the Taser before he was handcuffed.
So which is it?????

I'll wait for the follow up reports to have a totally different story :smile:

Not necessarily going to involve female officers. On the surface, this incident seems to indicate nothing other than bad luck and bad tactics. Otherwise, I might even expect to hear of a taser barb being removed from a very sensitive part of the suspect's anatomy.

FWIW, the first incident I heard of where officers used a taser but were unable to control the suspect with it was a domestic violence call that resulted in the death of a 31-year-old, male rookie officer who hadn't been on the street much more than a month in El Paso. Rookie and his field training officer(FTO), both males, approached a male suspect who already had a gun in hand. Yeah, goofy place to employ a taser in the first place but they believed there actions to be reasonable at the time. Anyway, the rookie fires the taser at the suspect but both barbs miss. Don't know if the rookie took this action on his own or under direction of the FTO. Regardless, the initial report said the FTO and Rookie turn tail and run from the suspect when it becomes evident the taser failed. Don't know why FTO didn't have a gun covering the suspect while the rookie covered him with a taser. The unfortunate result is the rookie is shot in the rear-thigh/buttocks (can't remember left or right) while running away and subsequently bleeds to death. IIRC, backup officers ended up shooting the suspect, arresting him and taking him to the hospital for treatment.

Tasers are not perfect and don't affect everyone as desired. Much like OC, everything has to go right for it to work. I have seen several dash-cam videos of suspects getting shot with tasers but immediately removing the barbs and proceding to assault the officer. The best dash-cam video by far I've ever seen was an officer who smartly skipped the taser and shot the suspect twice with his firearm. Unfortunately, the suspect's reply was "You're going to need more than that today!" The suspect was ultimately shot eight times before he was impressed enough for the officer to gain the upper-hand and restrain/arrest him. IIRC, that suspect also survived his wounds to stand trial.

TPC 1.07(a)(8) "Bodily injury" means physical pain, illness, or any impairment of physical condition.

By that definition, the Taser causes bodily injury.
