Well, that's a welcome development -- I'd much rather the NFA be trashed wholly, by congress, though.

Gun porn, clearly.

Question for those in the know: the difference between a AR-15 Short Barrel Rifle and a AR-15 Pistol is the stock on the rifle and a $200 tax stamp?
I know the AR-15 pistol lower must be designated as a "pistol" from the manufacturer. So, if I buy an AR-15 pistol and at some point in the future the NFA restriction on short barreled rifles goes away, just adding a rifle stock makes it a "rifle" instead of a pistol.

You building it or buying it with these specs?

I have been shooting my SBR with a Brace, just because I am too cheap to buy the stock I want, and no one has said boo about it

Receivers are neither rifle nor pistol. They are simply receivers and are logged as such. What you cannot do, is take something built as a rifle and convert it into a pistol - at least you're not supposed to. You can, however, convert your pistol into a rifle and then back again. Now, if you want to convert rifle or pistol into an NFA item, i.e., a short barreled rifle (barrel is less than 16" or overall length is less than 26") - you need the tax stamp.
SBRs are a better solution. Pistol braces are a nifty solution. Retirement of the NFA is the ultimate solution.

The ATF did this because after much dithering I just finally sent in my application to SBR my AK pistol a couple weeks ago. You're all welcome very much.

I stumbled across a nice upper and lower already assembled and reasonably priced at the gun show in Mesquite last weekend. So am just making mods. Am working with the guys at Charlie Squad (
http://charliesquad.com), I bought that 5.56 pistol from them that you saw me with at the last HG class and they are really great to work with...

This is an example of asking the question until you get the answer you (don't) want. It's highly unlikely that an item that was determined legal to purchase without NFA approval, would support a prosecution based on how you handled it. But there are people out there that keep writing NFA Tech Branch asking more and more obscure questions until they can hold up to ridicule?
Is a rubber band a "machine gun conversion" kit? No. What if you use it to hold the sear back on an AR-15 and it fires until the mag empties, but it was Sunday when the moon is full? Yes. What A RIDICULOUS RULING.
If you shoot a rifle with one hand does it become a pistol?
Does a circle slash elephant sticker mean that elephants will be arrested for trespass if they pass it? Republicans? Only people who have voted for a Republican candidate in the last 2 years? How do you orally notify an elephant? What if you hide the elephant under a tent? Can I identify as a Democrat to pass the sign? What if there is a Donkey sign and an Elephant sign on the restrooms? Is it 30.05 criminal trespass to use the restroom that is different than your political persuasion? What if you're independent? Or "Questioning". Bi-Political? If a circle / gun bans carry under 30.05, then does a picture on the restroom ban trans-females from using the Ladies Room? What if it says ladies only?

It's not like it's approved to be shoulder fired as standard.
"To the extent that the January 2015 Open Letter implied or has been construed to hold that incidental, sporadic, or situational “use” of an arm-brace (in its original approved configuration) equipped firearm from a firing position at or near the shoulder was sufficient to constitute “redesign,” such interpretations are incorrect and not consistent with ATF’s interpretation of the statute or the manner in which it has historically been enforced."

Well if it said "Ladies only" then I know a few females who would be banned from using it. I suppose any female would be at risk of taking the RIDE and having to prove in court that they are, in fact, a lady.
Same goes for "Gentlemen's clubs". I suspect there are several non-gentlemen at such clubs every night that are risking arrest and prosecution under 30.05.
