VFW Posts redux

In another thread the subject of VFW posts being 51% came. I recently attended a chicken fried steak night with a friend who belongs and the subject came up. He and the bartender were of the opinion that the 51% included the bar and the open area around it (bar, stage and dining area), but not any of the other rooms in the building. I checked TABC and one address is listed, there is nothing that indicates the license is for a portion of the building.

I disagree with friend and bartender and think it covers the entire building *and* the outside party area.

You would be correct, but there should be somewhere, on the premises, the exact floorplan, that details the areas, covered under the permit. Most places, will cover the entire floorplan, but some will exempt areas, usually larger venues with backstage areas etc ( like Billy Bob's) more than likely the VFW has the entire property covered including parking areas. But they are required by TABC to have the floor plan on site.

If you can take a drink from the bar and go anywhere else in the building or to the outside gathering area, then, all of that is 51%. If an area is not excluded then taking a drink from the bar to that area would be a TABC violation.

I believe that's how it works. Not certain.

It's certainly logical.
