Local Bowling Alley Red 51%

Post by RetNavy »

submitted to the TABC the other day about our local bowling alley being a 51% place. It does have a bar area inside the lanes.... received a call today from TABC and basically he explained that the bar is a private club (does have a N in the license number) therefor is allowed to make the entire building off limits to CHL holder's. I then asked why the permit on the website and in the SpiritsTexas app says it should be a BLUE sign.... and basically he said the permit is wrong because he has done audits on the business and they make more selling alcohol than bowling...(day i was there, 3/4 of the lanes were in use and the bar area CLOSED)

if and when i go there again will check site again and if it says BLUE will carry anyways...

You need to be careful. You have been advised that the location IS a 51% establishment, and that the database is incorrect. You have also just posted this in a public forum, so if you are caught carrying, you have no legal ground for a defense to prosecution.

Is there another entity showing up for that particular address? If so, they may have set up a separate entity, private club, to operate the bar and designated the entire bowling alley as their serving area since people take drinks back to their lanes and drink while bowling.

I think you are would be on very thin ice if you carry there after having it explained to you it is a 51% location.

One suggestion; physically go to the bowling alley bar (unarmed) and look at the actual license on the wall. If it says BLUE on the license, then you would have a defense to prosecution for the sign being incorrect. If the license says RED, then you know that the database/SpiritsTexas app is incorrect.

If the TABC agent said he audited it and the database wrong, did they then issue a new license with a "gun sign" = RED? Because if they didn't then it seems that the agent is proving himself wrong.
