Two Questions Regarding CHL

My Uncle is having problem with his CHL in Austin. He has already took his CHL Course and sent it in. On Friday he received a letter from Austin saying they need paperwork and signed by the judge about his conviction. My uncle has been clean the last 10 years. He made a stupid mistake back in '96. I didn't want to ask what he did, but all he told me that he has deferred adjudication.

- Is he still eligible to get a CHL? If so, what can he do to get this process?
- Does he needs a lawyer to help him out?

Me and a coworker were talking about getting his CHL. He asked me a question regarding about Military Discount for CHL. His last active service was in '97. He served in the Military for 4 years back in '93-'97.

- Is he still elgible for Military Discount? If so, what does he need to do/have to get this process?

My instructor said on the yellow form put in ALL infractions (that resulted in arrest), even juvenile ones

He said omission to them is like a lie, and we know how the govt treats falsifying records...good thing they gave him a 2nd chance..they could have denied it RIGHT THERE

He has to send Austin the records they requested, no way around it.

Well, if its a felony, then its pretty much over...And he should have known that it was going to be a show stopper when he took the class...The instructor should have explained that...

But if its a misdemeanor, then he "may" be ok...

The question is not answerable with the information provided.

Your uncle took the class, he heard the eligibility requirements. He also knows what it was that he did 10 years ago.

There's your answer. Either send in the disposition paperwork that DPS requested, or consider your $140 fee a donation to the state, and let it go.

From what Charles said in another post, even if it was a felony, successful completion of Deferred Adjudication means no conviction for NICS and CHL purposes. They likely just want official paperwork that he got Deferred Adjudication and successfully completed it.

He is still a veteran. As long as his discharge was under honorable conditions he will qualify for the disocount. I am sure that he will need his DD214 to prove his status (he will know what this ). if there are any other specifics I am sure that one of the instructors on the forum will chime in.

Curious: Is this the same 'uncle' you asked a question about 2 months ago? Was he the one who had problems with his truck due to vandalism?

I'm old and my memory is fuzzy, please clarify?

I got about 8 uncles. The one your asking already have his CHL. This one is a different one.

Look at 141.1711 and there is your answer. I fall in the same boat here in a couple of days. What it seems to come down to is the part about defered adjudication. If the deferred adjudication was entered against him on a date not less than ten years ago he is not considered "convicted". He will however need to send in CERTIFIED copies of his paperwork from the court. Do a search for my post called Eligibility and also search for posts by user name Brass Monkey.

Been there, done that, faxed the paperwork, had CHL in a few weeks..
Just send in the paperwork and don't sweat it.
