on the traveling issue, the presumption under the current law would be easy to overcome. He clearly wasn't on a trip, which is basically how traveling has been defined by the courts. The current law did not redefine "traveling", it just gave a presumption. Under the new law effective Sept. 1, we wouldn't have this discussion.
