I wonder if she drinks at the same bar as Rosemary Lehmberg. She'll go far in Austin politics now!

Edited. I just noticed this in the article :lol: This one barely skated by.

"Last year, Travis County Judge Gisela Triana was arrested and charged with driving while intoxicated. The charge was later dropped because “the blood test taken that night showed Judge Triana to have a blood alcohol content of 0.076, under the legal limit of .08,” said Travis County Attorney David Escamilla in July.."

Correct me if I'm wrong, but I was under the impression that you can still be charged if under legal limit. You know that whole "buzzed driving is drunk driving" thing the states have been doing ?

You can be charged, as "driving under the influence" is up to the officer's discretion. They still won't prosecute for DUI if it is under the .08 limit, because they wouldn't get a conviction.

I guess "passing the bar exam" in the prosecutor's office has a different meaning than everywhere else. :cheers2: :smash: :smilelol5:

Actually, they will. Have seen it multiple times. A combination of drugs and alcohol, or no alcohol at all and just drugs, even legal or prescribed, will be prosecuted if there are circumstances that justify going after the person. It may be harder to get a conviction, but it is not that big a task if the prosecutor and the police do do a good job building their case.

Technical/procedural question: Do the machines produce a printable record? Do they go to the thousandths place for everyone, or round up, or ... ?

You are correct if other drugs/narcotics are detected in the blood test, I was referring only to the blood alcohol levels.
