Chl denial

Post by Tony1960 »

I was denied my chl in 2014,I had a felony conviction in Louisiana in 1997 for Marijuana possession didn't report it when I applied ,they asked for the disposition of the case so I sent them a copy of the original conviction not knowing that after my 5yr probation I was given a first time offenders pardon in may of 2002 ,my question is can I resubmit a new application along with a copy of the pardon ,and will that reverse my denial ,I've looked it up in Louisiana and it states 10 yrs after pardon gun rights are restored ,fyi I live in texas

If you had disclosed the arrest and convistion as required, I think you would be clear to reapply, but I think there is a five year waiting period before you can reapply if you lied on the application. IANAL
This is my opinion. There are many like it, but this one is mine.

A pardon under Texas law means you would be eligible and it's likely that way for a pardon from a different state. Since it is not a Texas pardon, I can't opine.

The way I read it you would be eligible.
411.171 Definitions
(4) “Convicted” means an adjudication of guilt or, except as provided in
Section 411.1711, an order of deferred adjudication entered against a
person by a court of competent jurisdiction whether or not the imposition of
the sentence is subsequently probated and the person is discharged from
community supervision. The term does not include an adjudication of guilt or
an order of deferred adjudication that has been subsequently:
(A) expunged;
(B) pardoned under the authority of a state or federal official; or
It doesn't specify which state and 411.1711 doesn't apply, therefore he would not be guilty of felony charges unless I'm missing something.
