State Rep. Abel Herrero's father died early Saturday after hitting his head during a confrontation in a restaurant.
Ivan Herrero, 59, and his wife stopped at Denny’s on the Interstate Highway 37 access road near Navigation Boulevard about 10:30 p.m. following the Juan Gabriel concert, police said. A man cut in line for a table, and Herrero told the hostess that his party arrived first, police said.
Words were exchanged and the man hit Herrero twice in the head, causing him to fall and hit his head hard on the floor, said Police Chief Bryan Smith.
Herrero was conscious when officers arrived, Smith said. The suspect was arrested for aggravated assault.
Herrero was taken to the hospital, where he died, and charges were updated to murder, according to reports.
“It’s a tragic incident,� said Smith. “Appears to be an unprovoked case of violence.�
Abel Herrero, D-Robstown, or his brother Ira, a Corpus Christi police officer, could not be reached for comment.
Members of the local legislative delegation, who had heard about the incident early Saturday, said they were saddened by the news.
“It must be heartbreaking to lose a parent,� said state Rep. Solomon Ortiz Jr., D-Corpus Christi, “and I offer my deepest condolence to Abel and his family, and we will keep them in our prayers.�

Pretty sure those aggravated assault charges will be upgraded...
But all in all, this is a situation where it would not have made a bit of difference if a CHL'er would have been there or not...
It does prove how "more" intolerant some people are in public these days...
