I was recently denied a LTC. I currently hold a LTC in the state of Virginia. I got it when I was stationed there at Quantico. The reason I got denied is because I disclosed that I did a rehab program while I was in the Marine Corps in 2016. I successfully completed the program and went back to my job and finished out my contract. I never got non judicial punishment and they did not take my TS clearance away either. I never got in trouble for going to the program. I asked for help and the Marine Corps helped me out. I was honorably discharge after my contract was up. I disclosed the same thing on the Virginia LTC application and was approved. I have a clean record and I believe I should not be denied. Is it worth appealing and if so, should i get legal representation or appeal it on my own. Not sure how this whole appeal process works.

I am not an attorney and this is not legal advice or legal opinion: you did not disclose the nature of rehab - but most likely you need to get that 5 years behind you to qualify. You are at the 3 year mark now.

Texas is not Virginia. The bigger question is: will Texas honor reciprocity for your Virginia license after Texas denied your LTC application - assuming you are a Texas resident.

That is kind of what I was thinking. That i had to wait the 5 years but another question is, am I going to have a problem applying after the 5 years. Are they going to see a denial in my name when i go to apply again?

I understand its two completely different states, I just thought I would do the same thing on each application and it would be fine. So far my Virginia license is good until 2021 and as far as i know Texas recognizes Virginia LTC.

My recommendation is to talk to an attorney, find out about the appeal process. I think you have to go to a JP. You might find a judge with a friendly ear.

I agree with One Gun, you might find a judge with a friendly ear. Considering you had a TS clearance and you asked for help on your own and was honorably discharged I think you have a good shot at an appeal. You have nothing to lose by appealing this decision.

It’s 5 years for any alcohol and/or drug treatment. You will be ok after 5 years to re-apply. Yes, you can carry under an out of state LTC in meantime. (like Virginia, FL, AZ, etc).

I figured that would be the case but I wasn't sure. I do not mind waiting the 5 years since I already posses an LTC from Virginia plus getting an attorney can be expensive. I just didn't know if i would run into problems when I go to apply after the 5 years. For example, are they going to see that denial when i go to apply again?
