Is there anything forbidding carrying concealed while huntin

Post by mrvmax »

I didn't see anything on the DPS website or in the hunting laws handbook but I may have missed it. Is it alright to carry while deer hunting?

Yes. Corps of Engineers Lands are a (rare) exception.

I typically open carry while hunting. Of course I don't while bow hunting, and I am on land under my control...

Where did you see this? There are several WMAs around here that are CoE lands that I hunt on... why would CHL be illegal?

"Where did you see this?"

For one, the Corps of Engineers regs. given to all parties who obtain the hunting permit for Lake Lewisville and Lake Grapevine. There have been other threads here on the forum regarding carry on Corps property. Yes, it can be a controversial can of worms, particularly when hunting or fishing.

While Texas Parks and Wildlife does state (for example, in their public hunting lands booklet) that CHL holders can carry in certain locations, an "ADVISORY" on page 73 of The Outdoor Annual states: "It is the responsibility of the hunter to be aware of applicable federal regulations on federal lands (Forest Service, National Recreational Areas, etc.)."

This is from the guide TP&W issues:

Archery and Crossbows
(see Artificial light in Restricted Methods section)

Only the archery and crossbow equipment prescribed in this section may be used for taking game animals or game birds. Crossbows are not lawful for taking migratory game birds. The prescribed archery and crossbow equipment may be used during any general open season. Archery and crossbow equipment may not be used to hunt deer during the Muzzleloader-Only Deer Season. It is unlawful to be in possession of a firearm while hunting with a broadhead HUNTING point during the Archery-Only season, except a person licensed to carry a concealed handgun in Texas may carry a concealed handgun. NOTE: A firearm may be possessed in camp, in a motor vehicle, or while hunting lawful game other than whitetail or mule deer and turkey (e.g., exotics, feral hogs, squirrels).
There will always be prayer in schools as long as there are tests.

Title 36 - Parks, Forests, and Public Property
CHAPTER III - U.S. ARMY CORPS OF ENGINEERS
PART 327 - RULES AND REGULATIONS GOVERNING PUBLIC USE OF
WATER RESOURCES DEVELOPMENT PROJECTS ADMINISTERED BY
THE CHIEF OF ENGINEERS

327.13 Explosives, Firearms, Other Weapons and Fireworks.
(a) The possession of loaded firearms, ammunition, loaded projectile firing devices, bows and arrows, crossbows, or other weapons is prohibited unless:
(1) in the possession of a Federal, state or local law enforcement officer;
(2) being used for hunting or fishing as permitted under Section 327.8, with devices being unloaded when transported to, from
or between hunting and fishing sites;
(3) being used at authorized shooting ranges; or
(4) written permission has been received from the District Commander.
(b) Possession of explosive or explosive devices of any kind, including fireworks or other pyrotechnics, is prohibited unless
written permission has been received from the District Commander

327.26 State and Local Laws.
(a) Except as otherwise provided herein or by Federal law or regulation, state and local laws and ordinances shall apply on project lands and waters. This includes, but is not limited to, state and local laws and ordinances governing:
(1) Operation and use of motor vehicles, vessels, and aircraft;
(2) Hunting, fishing and trapping;
(3) Use of firearms or other weapons;
(4) Civil disobedience and criminal acts;
(5) Littering, sanitation and pollution; and
(6) Alcohol or other controlled substances.
(b) These state and local laws and ordinances are enforced by those state and local enforcement agencies established and authorized for that purpose.

327.13 I would say no. 327.26 I would say yes.

I will uncloak for this one thing - Greybread is correct - Corps regs prohibit firearms (except allowable hunting arms of course) on Corps owned lands and Corps owned lands that are licensed/leased to TPWD. I have a letter from HQ USACE Office of Counsel which specifically addresses Texas concealed carry on Corps lands if anyone wants it (PM me). I will return to lurking now....
