Another question on Locations

Post by rm9792 »

I saw in the latest CHL handbook that telecommunications switching facilities are off-limits always? Is this the case or do they have to be 30.06? Why were they singled out?

You're talking about PC §30.05, criminal trespass. If you have a CHL and are legitimately allowed to go into one of the places listed there, you're not trespassing.

A telecommunications switching faciity is most likely off-limits to the general public, and you wouldn't be there unless you were an employee or vendor.

I don't know why specific places are listed there. Either the legislature thought trespassing in them was a more serious violation than in general, or the industry wanted it.

Many of those were placed in the statute to try and help prevent intelligence gathering sessions by individuals post 9/11. Hence the critical infrastructure locations.
