CHL-savvy lawyer

Post by AJKAHR »

I'm preparing to go through the CHL process very soon. One of the things I've read most on different forums and CHL info sites is "What to do if you've cleared leather or actually used lethal force against someone". Most all of the advice says:

1.) Eliminate the threat
2.) Make sure you and yours are safe
3.) Shut up and call your lawyer, wait for LE to arrive

1 and 2 fairly easy to follow. It's 3 that I think is always the hard part. My question is simple, who knows of one or how to find a good general practive lawyer that is CHL aware/pro/carries, etc.?

My wife and I have a family doctor, shouldn't we setup a relationship with a family lawyer? We really should have things like living will, final will, etc. And I would prefer that the same counsel be the one I call in the event I need to use my weapon.

First, don't use "Eliminate the threat". You want to "Stop" the threat.

As to the lawyer piece, I don't think you need that unless you have to defend your actions in court (civil if it comes to that). Until that time, be honest, tell LE what happened, why you were in fear of your life or harm, and don't use the words kill (or the like). Don't offer any more information then you need to. If you feel you are being unjustly dealt with, then stop answer questions and seek out a lawyer.

To get rid of; remove.

!=KILL

Eliminate the threat, not necessarily the person threatening.

Thanks for your insight anyhow.

I'm not sure if you're familiar with Austin but it's not the most conservative area of Texas. With Ronnie Earle running around convening grand juries like they are support groups, I don't trust APD/TCSO past what the DA might force on them. I would rather only tell LEO that I feared for my life and I would submit a written statement through my lawyer.

Now, I need a lawyer and not just for CHL related issues. I posted this question looking for assistance in finding one that could provide counsel in all areas I mentioned. If anyone else has experience with good lawyers in town, I would greatly appreciate any information you could provide.

I'm assuming you haven't taken a CHL class yet, right?

Part of the course will deal directly with this subject in the Use of Force (Ch.9) curriculum. As a CHL Instructor, I would strongly recommend taking the course before getting into the "what-if's". Your instructor will cover the latest info regarding common sense procedure for dealing with the aftermath of a shooting. So far the current DPS recommendations are about the best I have heard from anyone.

For a good Attorney that is Pro carry and knows the law in the Austin Area the one I would call is James O.Burke he lives in Manor and works in Travis and Bastrop counties.

I have spoken to him about this and he is ready to help at anytime .

Here is his Number 512-276-9777 and his Pager is 512-860-5777.

I would remember that when it happens to have his number handy .
