CHL Eligibility of Visa'd Aliens

A foreign national in this country on a (working) visa can legally buy a firearm if they have a hunting license, Texas Drivers License, an Immigration number and evidence of (minimum) 90 days residence.

Are they eligible to apply for a CHL? I can't find anything in GC411.172-Eligibility or GC411.174-Application that suggests any restriction.

This question was put to me by a Canadian that expects to be working in Houston for five years on a working visa.

Any information on this would be appreciated.

From the DPS website:

Q: If I am a legal resident alien, can I get a license?
A: It depends. A resident alien who has been admitted to the U.S.
under an immigrant visa category will generally be eligible for a
concealed handgun license. However, under federal law, an alien who
has been admitted to the U.S. under a non-immigrant visa usually is
not qualified to purchase a handgun and thus is not eligible for a
license. If you legally reside in Texas and were not admitted to the
U.S. under a non-immigrant visa, you may be eligible.

The answer in the DPS FAQ is very confusing and vaguely worded. They are referring to federal law, and if you go check out the ATF's FAQ on their website, they put it in plain language: If you are a legal resident alien, you are NOT a "non-immigrant".

What kind of visa you entered with is a moot point after your status has been changed to Resident.
