Herman Park, Houston

Hello Everyone: Name Is Brian, New to the Board, been Licensed since October 07.
I have a Question about carry concealed there, I take granddaughter to this Park, I've read the Law concerning carry at Amusement Parks, but this Park is big, and not all of it has amusements on it, Am I allowed to Carry here???.
Someone Please get back with me as soon as Possible.

Welcome to the forum.

You can carry in Hermann Park, as in any city or county park. The City of Houston has the occasional funky sign that they were trying to use to keep out CHL holders, but a judge ordered them to remove those signs from the parks.

The only amusement parks that fit the legal definition are Six Flags and SeaWorld. They also need to have 30.06 signs to keep out CHL holders.

Thanks Jim, I do appreciate your help, I wasn't clear at the time if Herman Park was considered an amusement park or not because of the Train and Zoo.glade I got that resolved.

I know it has already been resolved, but a definition is frequently given in the statute, usually at the end. For example, amusement parks are defined at the end of TPC § 46.035:
§ 46.035(f) In this section:
(1) "Amusement park" means a permanent indoor or outdoor facility or park where amusement rides are available for use by the public that is located in a county with a population of more than one million, encompasses at least 75 acres in surface area, is enclosed with access only through controlled entries, is open for operation more than 120 days in each calendar year, and has security guards on the premises at all times. The term does not include any public or private driveway, street, sidewalk or walkway, parking lot, parking garage, or other parking area.
The restriction on amusement parks (as well as hospitals, churches, and government meetings) has essentially been irrelevant since § 46.035(i) was enacted, requiring these places to post a valid § 30.06 sign if they want to exclude lawful CHL holders.

Is the amusement park description still in the code for any reason? Are there any other relevant laws, restrictions or harsher penalties for things done at an amusement park, or was this originally written strictly for the CHL?

My understanding is that the management of Six Flags in Houston threw a hissy fit when the CHL law was being drafted, and this provision was put in to satisfy them. Later PC 46.035(i) was passed. It was easier than taking out amusement parks.

Six Flags in Houston had closed by then.

I didn't live in Texas before 1995, so this is all scuttlebutt I've picked up.

Thanks. I guess the legislature does have better things to do then axe archaic definitions.

The LAST time I went to Six Flags, there was nutin but trash walking around, looked like Gangbangers and people no descent family would want their children around, I have my own ideas as to why Six Flags closed, Troublemakers!!!, and practically all of them were probably carrying.
