Appeal of Harold Fish Moves Forward

Harold Fish is a retired Arizona school teacher and father of seven children convicted in 2006 of second degree murder and now serving a ten year sentence. The prosecution and trail of Fish appears highly onerous on the part of the local district attorney and the state district court where the case was heard. It's a shinning example of all that can go wrong following an apparently justifiable self defense shooting. This latest filing in the appeals process is good reading for anybody who might ever have cause to use a firearm against another human being:

Bump. 101 views, no replies. I'm relieved to find this case leaves somebody other than myself at a loss for words. What an incredible judicial fiasco this guy has gone through. I thought this one deserved another turn at the top for any latecomers based on the subject matter.

I tend to avoid commenting on this kind of topic because nothing I say will make the least difference to Mr. Fish's appeal.

It sounds to me like the trial judge was prejudiced or incompetent; and I'm hoping that Mr. Fish gets a retrial, if not outright vindicated.

So many bogus issues were raised in this trial that I recommend that people not use them as reasons to avoid doing this or that. The number of weapons that Mr. Fish owned, the targets in his vehicle, and the caliber of his pistol should not have been admissible as evidence at the trial.

I always ask what we can learn from events. Here is what I think I have learned:
  • Always carry a non-lethal weapon like pepper spray. I think if Mr. Fish had been carrying pepper spray, we never would have heard of him.
  • If confronted by a lone, unarmed attacker, do everything possible to terminate the confrontation before shooting becomes inevitable. Every defender with a CHL who has been prosecuted in Texas has shot an unarmed attacker.
  • If the police arrest you, shut up. Don't talk to anyone but your lawyer. This may be hard on your family, but look what happened in this case.
  • If you are charged with criminal homicide, get the best lawyer in the state. At that point, your life is ruined, and it doesn't matter how much money you spend.
