Port of Corpus Christi carry/Joe Fulton Corridor

Post by iflyabeech »

I have a friend who talked to a Port of Corpus Christi police officer who told him, "......you are not allowed to have a firearm on the new corrider Road or on the river parking there because its considered part of the Port of Corpus Christi and it under strict rules."

Here is the road in question: Image

It is a public road with no signs on either end and no delineation marks or anything...Its just a normal road.

Here is the sign at the entrance to the river fishing parking lot

Can anyone help us with this? I would like a link to the actual law or some guidance instead of an opinion.
Thanks in advance!

:iagree:

Ports have acquired seriously swollen heads since 2001. The Port of Galveston police arrested a fairly well-known local photographer for taking photos from a public sidewalk. The situation ended up with dropped charges and apologies.

I have no clue about where the Port of Corpus Christi gets its authority, but I know of no legal basis for saying that weapons are prohibited on a public road.

PC §30.05 was modified several years ago to include the special category of "critical infrastructure facility," which includes ports. However, trespassing on one of these facilities requires notice, which I don't see in this case.

All critical infrastructure facilities have fences that you could not possibly cross without a lot of work.

It sounds like many of these verbal warnings and restrictions come from people who do not accept the fact that CHL holders are within their rights to carry it and are perty much "julaous" and find other laws and reasons to scare you and know that if you try to fight it in court, most of the time judges will rule in favor of the LEO's/security guards etc... That is my opinion.

Subject: Concealed Carry

Mr. Archambo and Mr. LaRue,

A friend of mine recently spoke with a Port police officer who told him that concealed carry by a Texas concealed handgun license holder was not allowed along the Joe Fulton Corridor or on the fishing parking lots on the river.

Here is a copy of Texas 30.06 which deals with “TRESPASS BY HOLDER OF LICENSE TO CARRY CONCEALED
HANDGUN. “

http://law.onecle.com/texas/penal/30.06.00.html

Please notice section 30.06 e, which states:
It is an exception to the application of this section
that the property on which the license holder carries a handgun is
owned or leased by a governmental entity and is not a premises or
other place on which the license holder is prohibited from carrying
the handgun under Section 46.03 or 46.035.

And here are the prohibited places page:
http://law.onecle.com/texas/penal/46.03.00.html
http://law.onecle.com/texas/penal/46.035.00.html

I would appreciate it if you would clarify this with me so that I and other CHL holders may stay within the law.
I can find no law which would prevent concealed carry by a licensed individual. If I am wrong, can you please provide me a link to the law?

Please remember I am not talking about carrying in a secure area. I am talking about public areas and public roads.

Thank you for your time!

I look forward to hearing your answer.

Sincerely,
Kelly Harlan

Mr Harlan, Thanks for your e-mail. Sorry we didn't respond earlier. We have an e-mail program that automatically sends unknown addressees mail to a separate file that is huge and getting larger exponentially due to unwanted solicitations. I failed to recognize and pull your e-mail to an active file. Again sorry. Okay, to your question as to concealed carry. You are absolutely correct and coincidently we have been researching that subject in reference to an existing Port tariff item that restricts firearm possession. We will be updating that item as soon as we have completed the research and will also be addressing restricting use of a firearm on Port property. The officer was probably still using the existing tariff wording. Again thanks for bringing it to our attention.

Good news for now, but it sounds like we might have to argue with them more in the future!
