Day Care facilities and premises...

Post by stevie_d_64 »

Ok,

I've look high and low, and have not seen a clear definition of this issue...

Situation:

I work in an office, surrounded by a large day care facility...Our parking is right outside our office door, no where else to go, etc etc...

I happen to work for a great firm that does not have a problem (as long as I am discrete) carrying and maintaining control over my firearm...

I don't like leaving it in a vehicle, so it stays in my desk most of the time...

My concern is that am I legal to have it in this situation considering my surroundings...

I know what people don't know won't hurt them (except the bad guys), and I surely do not ever expect to have to implement a defensive action (per our State law)...

Just thought I would throw that out there and see what ya'll think...

Later,
Steve

Steve:
If I understand your situation, you are fine. A true day care facility is not a "school" and is not otherwise "off limits" to CHL's. If the facility also has a traditional school, for example offering kindergarten, first and second grade classes as do some facilities I've seen advertised, then it is a school and you can't go into their building(s).

I am not clear whether the day care center is in the same building as your company, but even if it is a "school" based upon offering the above-mentioned classes, only their portion of the building should be off limits, because the definition of "premises" includes the phrase "building, or portion of a building."

Regards,
Chas.

The daycare directors office is nextdoor to our office in the same "strip" center bank of offices...There's also a tax lawyer just on the other side of the daycare directors office and a psychiatrist office next to us on the other side of our office...Kind of a hodge-podge of stuff, but the daycare is the dominant occupiers...

The kids are down on the far end of this buildings' structure...

And they (kids) also occupy the strip center "offices" just across the small parking lot between the buildings...

So really its just something that has bugged me since I have worked here...

Personally, I just don't think there's anything for others to worry about me (and my secret) I suppose...

Another thing the daycare folks offer is a private bus service that picks up the "older" kids and occupies them at the center here till the parents come by and pick them up...

All in all, since I watch what they do everyday outside my window here, I see them doing a great job in taking care of the kids...

Just some introspection I suppose...

And to think I still get my work done! Go figure...

You are fine; no CHL problem at all.

Chas.
