51% Sign Question

I was at the Hilton in College Station the other day, and I came across a unique circumstance, and I figured I would ask about it here. I was not carrying at the time, because I was about to go swimming, and it's hard to conceal a G22 in white swimtrunks (I'm working on it tho!)

The Hilton is not posted 30.06, nor is it eligible for 51%. However, when I went into the bar in the lobby of the hotel, I noticed a 51% sign on the wall underneath the TV. I thought for a second that it was complete bull, but then I thought that if the bar is independent from the Hotel, then it could be an enforceable sign. There is free, unhindered access (aside from a couple of steps) from the main walkway in the lobby to the bar, so I thought that the bar was just a part of the Hilton. Does anyone know the policy which even COULD make that sign legal?

It only matters what the license says. I've noticed that in many places the license is posted some where that I can sneak a peek at it.

Just for the fun of it, I went and looked up the license on the TABC site (http://www.tabc.state.tx.us/publicinquiry/Status.aspx) Searching for Hilton in College Station didn't get a hit but after finding that address the below came up. Bar/restaurant is evidently run by someone else, probably paying rent/slice to Hilton.

And the policy that would make the sign 100% legal is a semi-unknown TABC ruling. Normally, a TABC license covers the whole premises (including the parking lot) for the location it is issued to. But, a store owner may also do what is known as diagramming off a portion of the property. In a case like that, the license application gets a diagram with it that shows the parts of the premises that the owner wants the license to apply to.

In a case like this, it is probable that the bar was diagrammed off from the rest of the hotel. The 51% sign may be valid and apply only to the rooms the bar is in and stores its liquor in. In a case like that, you could not carry in the bar but could legally carry in other parts of the hotel.

Would this be the same area that you are not allowed to remove a drink from?

In most cases, yes it would be the same area. Of course, an owner could post any internal house rules he wants, including keeping the alcohol in one area. That would have nothing to do with the license so don't assume the two are always related.
