Class A Misdemeanors?

Post by BowhuntinTx »

I was charged (never convicted) of a Class A misdemeanor (wreckless driving). My lawyer was able to get me defferred adjudication with one year of probation. I finished my year of probation back in 9/04, that should make my date of deposition 9/03 right? I have made several calls to Austin to ask them if that would keep me from getting a CHL and haven't had any responses. If the "last 5 years" rule goes by date of deposition I should be ok... right?

You should be good to go. For CHL purposes deferred adjudication is a conviction so you will need to supply a copy of your case disposition with your application. One of the instructions on the forum may be able to give a better explanation than mine.

Contact the county criminal court clerk in the county where this all happened. You are going to need a copy of the disposition anyways, and then you will have your date. 5 years from your court date should be your magic day of eligibility.
