Selling your gun

If you sell your gun can you transfer it to their name? If so how do you do that? Thanks for your help.. DW

There's no such concept in Texas law. Swap the firearm for cash and you're done.

You can do it through a local FFL. It is not law that you do that in Texas.

You can indeed perform a transfer through an FFL. That would ensure that the buyer can pass NICS.

However, the FFL's records remain in his possession until he retires or dies. Therefore, they are not available to the authorities in the way that registration records are in some states.

That doesnt "transfer" it to his name, we dont have registration.

Yep, members of this board do it all the time. We meet say hi, change money for gun, chat then leave.

Only requirement is you cannot sell to a KNOWN felon or under legal age. All you need to do is take a look at their DL and deal in CASH.

As long as the purchaser is eligible to purchase a firearm per the BATFE guidelines and buying it for themselves.

Thats what some are hoping to change...

I heard a nasty rumor that there is a "transistion" commitee who are looking onto "data mining all 4473's"...This little tidbit of wonderful, warm and fuzzy regurgitated worm stuff popped up late last week...

Just in time to again not effect anything which happened yesterday...

But hey, its only s rumor...And there is just no way we need to worry about any of this.../sarcasm

You're on "the list" forever, even if you sell your guns through a FFL.

Just a note of caution re: retention of 4473s by the feds. When your friendly FFL quits the business or dies, all his records, including those 4473s you filled out over the years, go the the BATFE. There they sit until someone decides they want to "do something" with them.

Just recently I learned that the FFL I have been using - and probably some of you on this board as well - passed away.
So guess where those dozen or so 4473s I signed are headed?

Something to think about as you plan your purchases.
