Dallas Gun Show Magazine question

Post by texasag93 »

I went to the down town gun show in Dallas (Market Hall?) about 4 months ago and forgot to post this question.

They had 30.06 properly posted (private property). I had my pistol as I was looking for a new holster. I was asked by the policeman doing the gun clearing (plastic zip tie) if I had any loaded magazines in my bag. I did not,but he said that if I did it was also a violation.

Is that accurate?

Thanks.

Market Hall has a "no loose ammo" rule. Not aware of any criminal violation for carrying a loaded magazine? They'd just have you leave if they caught you.

No.

You were given permission to enter with your pistol when they inspected and zip-tied it. There are no conditions to 30.06: either you are allowed to enter, or you are not.

PC 30.06 doesn't specify whether the handgun is loaded or not; if you unloaded your pistol and zip-tied it yourself, and passed a 30.06 notice while carrying no magazines or ammo, you'd be in violation. If you let the officer zip-tie your unloaded pistol while you had a pocket full of loaded magazines, you'd be legal. You'd even be legal if you went inside, snipped off the wire tie, and loaded up.

And unlike most LEO-Citizen interactions, you'd even be legal to lie to the officer about whether or not you had any loaded magazines, since he is not asking in any investigatory capacity. Not unlike if he asked "How 'bout them Cowboys?", and you replied that they're the best team in the NFL. A blatant lie, but not punishable. ;-)
