Well, the law certainly allows that doesn't it? In fact, the law doesn't do anything to prevent that. Gov code 411 regulates the DPS, not the local officials doing the background checks. When I called the DPS, the clerk started looking into the status of my application. I got the distinct impression that its status is just a general category of delayed by IKE, like there was a status field just for that. I didn't get the impression that it's waiting on anything. Applications in this status seem to be permanently halted as far as the DPS is concerned.
That's why I'm emphasizing that what we have is not a delay. It's more of an implicit denial. At 180 days, even the Gov code, poorly written as it is, starts to call this an implicit denial. We have people that are beyond 180 days still "waiting" on this "indefinite" delay. It amounts to a total and indefinite ban on handguns.

Really !!! .Do you have a reason for believing this? As far as my observations go Harris County Courts system has been CHL friendly. The Court system and the Law Enforcement system are two different animals. Its a big area but lots of agencies. and I suppose its all relative.
When the Rosenthal fiasco happened they really had to search to find someone who was effected by his policies. It turned out even though Chucky tried to get folks arrested for carrying, most of the HPD and Harris County Deputies seemed to respect the law as intended. I tend to believe when we rewrote the law and got rid if Chuckie the problem got fixed, and those who may have had similar ideas got educated. I'm don't mean to picking on you, but we really need to come down on those who oppose us and stand in our way. Just as important we need to recognize when our civil servants are friendly.

What's the difference? Regardless of the intent, the effect is the same. They have intentionally made administrative decisions that have effectively banned the issuance of CHL's in Harris county indefinitely. We don't need to read in an evil intent. The tax payers of Harris county have good reason to not want their money spent doing pointless background checks on law abiding citizens when they don't have the resources to check out the immigration status of violent criminals they've arrested before they set bail. It's in the news today that 178 violent illegal immigrant criminals have jumped bail and ran off back to Mexico. Sounds like a good enough reason to not allocate resources on CHL applications if you ask me. To me, what we need to flush out is that, regardless of their excuse of the day, these laws are intolerable. We don't need to tweak the process. We need to put an end to this nonsense once and for all.

If you search the forum for "Pat Lykos" (the newly elected Harris County DA), I believe you'll find that Charles has stated that she is a friend of CHLs, so the situations you're discussing should improve after she takes office.
