Gigag's post about his CTW has me wondering about something now but I didn't want to hijack his thread. I got a CTW after I sent in my packet. It's actually what made me find out my license was suspended if you'll remember another post of mine. By the way, that is all taken care of. The deputy that gave me the CTW was actually very friendly to my cousin and I. He told me that it would not go on my record and would not affect getting my CHL because I asked him that question specifically. Is this right? Is it in a log book but not on my record? Will DPS come across this and send me a denial because I got a CTW? At the time, I was more worried about the driver's license thing, but gigag's post gave me some new concerns.

And before anyone even asks, it's not a "he should have known better" CTW. A local ATV area near my house that I've been going to for 3 years, and others in and around my neighborhood have been going to for about 20, was bought from the previous owner. The new owner is not so ATV friendly. No one knew the land was bought, we didn't even know it was for sale. No markings were ever changed, no fences were put up and no purple paint was put anywhere. I, and about 10-15 other unfortunate souls in a weekend, found out the land had been sold by the deputy who turned on his lights as we came over a hill on my ATV. My cousin and I both got CTW's. But like I said, the deputy was courteous to us, he explained that the land had only closed that week and the owner immediately called SO and told them he no longer wanted ATV's and dirt bikes on the land.

So will the CTW count against me, or only if actual charges had been pressed? Anyone know? I'm sure txinvestigator has a knowledgeable response, I've gained alot from some of his others. Now I'm trying to remember if there's anything else STUPID I've done in the past few years!!!!!

A CTW is not a criminal charge. It's a warning, as the name implies.

It is your acknowledgement that you have been warned that you may not enter the specified location. If you do enter again, you have almost no defense when/if you are charged with criminal trespass.

The CTW form is kept on file at the offices of the LE agency that has jurisdiction. It's not entered into the criminal information computer system.

I'd comment on the actions of the landowner, who changed a longstanding practice without warning or notice, but the 10 year old daughter rule forbids what I'd like to say.

That's a plus. And I agree KBC. I don't even know how many of us from the neighborhood have been going there. Some of the old timers who've been here since the first houses were built in this subdivision say they've been going for 20+ years. It's like a neighborhood institution down the drain! We've actually met new people in the area and made some friends because of ATV riding there. It's really kinda sad.

Hadn't seen any posts from you for while. Glad you're still around. And I 'm glad you got your DL all straightened out.
Now you just have to wait out the folks down at the CHL Bureau. :smile:
