30.06 Question-My Office Layout

Post by CainA »

Main entrance to building, not posted, however, reception area is posted(reception area is theoretically a dead end; you have to go back out the door you came in). Secondary entrance is posted. Delivery entrance is not posted. Soooo, is this posted or not?

My opinion, If you are aware of a valid posting for the premises then its posted.
IANAL, what I write should not be taken as Legal Advice.

For you, you know the building is posted at some point with 30.06, so for you are legally bound by the signage.

As for someone entering that has not seen the posting, they are not notified until such time as they pass by a posted area, but at that point they are in violation if they don't retreat.

BTW, IANAL. ;-)

Yes, it's posted, assuming the signs are compliant in terms of wording and size. As FlynJay said, if you have seen a compliant sign then I believe it would be nearly impossible to defend against a charge by arguing about the number signs v. number of entrances, or the locations of signs.

If a sign is placed such that you are already in the building before it can be seen, then merely entering the building is not a violation, but staying after you've seen the sign is a violation.

The delivery entrance is non public. It doesn't make logical sense that an employee wouldn't know about the other entrances where it's posted. But I don't think they could prosecute someone who came in using the delivery entrance. If you could somehow prove you never used any entrance but the delivery entrance and it wasn't in any company handbook...... IANAL

Well, here's what doesn't make sense to me. If they want it "posted" why not post the 30.06 on the glass adjacent to the main(front) door, similar to they did on the what I have labeled "Secondary Entrance". I'm not too concerned about the delivery entrance not being posted, that's pretty much a loading dock where UPS, FEDEX, etc. etc. pull up and drop stuff off. It's pretty apparent that if you walk in through the "reception" doors you just broke the law. I guess I was under the impression that you can't(legally) go beyond the sign. And walking in through the front door (which again, is not posted) would be ok. I'm not going to test it though.
